New York Embraces Legal Cannabis!"

New York has officially joined the green revolution, becoming the 15th state to legalize recreational cannabis use. With this historic move, the Empire State is poised to emerge as a major player in the legal cannabis market nationwide. As of 2022, home cultivation (home grow) was limited to medical card holders, but recent proposed revisions announced on April 10, 2024, are set to allow non-licensed adult-use cultivation for the very first time in New York. Stay tuned for further updates on this groundbreaking change, which promises to reshape the landscape of cannabis accessibility in the state!

Summary of Allowed Activities: 

Certified patients aged 21 or older can cultivate cannabis for personal medical use. Designated caregivers aged 21 or older can cultivate cannabis for patients who are under 21 or have impairments preventing cultivation. Cultivation must occur in or on the grounds of a private residence. Limits for cultivation include up to three mature and three immature cannabis plants per patient at one time. No more than six mature and six immature cannabis plants are allowed per private residence or its grounds. Certified patients and caregivers can possess up to five pounds of home-cultivated cannabis at their private residence. Use of alcohol with a flashpoint below 100 degrees Fahrenheit is allowed for processing cannabis. Storage measures must ensure plants and cannabis products are not accessible to individuals under 21. Designated caregivers can cultivate for up to four patients but cannot exceed six mature and six immature plants at their private residence. Landlords cannot penalize tenants solely for engaging in authorized medical cannabis cultivation. Prohibited Activities: Selling or bartering of cannabis products produced from home cultivation to anyone other than a certified patient or designated caregiver. Processing cannabis using liquid or gas with a flashpoint below 100 degrees Fahrenheit without approval. Exceeding cultivation limits or possession amounts per the regulations. Selling cannabis seeds, immature plants, or cannabis to others, with some exceptions for transfers to certified patients or caregivers without compensation. These regulations are detailed to ensure safe, controlled cultivation of medical cannabis for personal use while preventing unauthorized distribution or misuse.
